What is a competent person?

A competent person is someone who has the necessary skills, knowledge and experience to help your business discharge the legal duties for health and safety.
Examples of competence may include:

  • Knowledge and understanding of the legal duties placed on your business for occupational health and safety
  • Demonstrable industry experience of the operational roles within the operating industries
  • Formal training and assessment
  • Professional membership of a recognised institution (IOSH or IIRSM)

Under the Health and Safety at Work etc. Act 1974, it is a legal requirement for all organisations that employ five or more people to have a written health and safety policy. This policy sets out how you manage occupational health and safety in your organisation by stating who does what, when, and how it will be done. As an employer, you must employ a ‘competent person’ to help you meet your health and safety duties.
